Welcome to Ponderare. Ponderare is a voice-first journaling and reflection tool designed to help you capture thoughts, revisit ideas, and generate personal insights.
These Terms of Service (“Terms”) govern your access to and use of our mobile application, website, and related services collectively referred to as the “Services.” By downloading, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Services.
Eligibility
You must be at least 13 years of age, or the minimum age required by local law, to use the Services. If you are under 18, you represent that you have permission from a parent or legal guardian to use Ponderare.
License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes, subject to these Terms and our Privacy Policy.
User Responsibilities
You agree not to:
Use the Services for unlawful, harmful, abusive, exploitative, or fraudulent purposes.
Violate any applicable laws, regulations, or third-party rights.
Use the Services to create, upload, record, or share content that is unlawful, abusive, exploitative, or violates the rights or safety of others.
Attempt to disrupt, interfere with, reverse engineer, or compromise the security, functionality, or integrity of the Services.
Misuse the Services in a way that could harm Ponderare, other users, or third-party service providers.
You are responsible for safeguarding your account credentials and for any activity that occurs under your account.
Content Ownership
You retain ownership of the recordings, transcripts, journal entries, reflections, and other content you create, upload, record, or provide through Ponderare.
By using the Services, you grant Ponderare a limited license to process your content only as needed to operate, provide, maintain, improve, and support the Services, as described in these Terms and our Privacy Policy.
Ponderare does not claim ownership of your personal journal content.
Our Content and Intellectual Property
The Services, including our software, design, branding, features, interface, logos, text, graphics, and other intellectual property, are owned by Ponderare or its licensors and are protected by applicable intellectual property laws.
You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from any part of the Services unless expressly permitted by us in writing.
AI Features and Generated Insights
Ponderare may use automated tools and third-party service providers to help transcribe recordings, organize entries, generate summaries, identify patterns, and provide personal insights.
These outputs are provided for personal reflection and informational purposes only. They may not always be complete, accurate, or applicable to your specific situation. You are responsible for how you interpret, rely on, or use any generated content.
Ponderare does not guarantee that generated insights, summaries, transcripts, suggestions, or reflections will be error-free or suitable for any particular purpose.
Privacy
Your use of the Services is also subject to our Privacy Policy. Please review it carefully to understand how we collect, use, process, and safeguard your information.
By using Ponderare, you understand that your recordings, transcripts, entries, and related content may be processed as described in our Privacy Policy in order to provide the Services.
Purchases and Subscriptions
Certain features may be available through in-app purchases, subscriptions, credits, or other paid offerings.
Pricing, payment terms, renewal terms, and cancellation options will be disclosed before purchase.
Subscriptions automatically renew unless canceled in accordance with the applicable platform rules, including Apple App Store or Google Play guidelines.
You are responsible for managing and canceling subscriptions through the platform where you made the purchase, unless otherwise stated.
Disclaimers; Not Medical or Mental Health Advice
The Services are provided on an “as is” and “as available” basis without warranties of any kind.
Ponderare is a journaling, reflection, and personal insight tool. It is not a medical, mental health, therapy, crisis intervention, or emergency service. Ponderare does not provide diagnosis, treatment, professional counseling, medical advice, or mental health advice.
Some features may help surface patterns, reflections, or supportive resources based on the content you choose to record, enter, or provide. These features are intended for personal reflection only and should not be relied on as a substitute for professional care.
If you believe you may be experiencing a mental health crisis, medical emergency, or immediate danger, please contact emergency services or a qualified crisis support provider right away.
Wellbeing Safeguards
As part of Ponderare’s safety-focused design, the Services may show supportive resources if your content appears to suggest serious distress or potential crisis.
These safeguards are not a diagnosis, assessment, therapeutic intervention, or emergency response. Ponderare does not contact emergency services, monitor you in real time, or notify third parties on your behalf unless required by law or with your consent.
You remain in control of whether you choose to access, save, or dismiss any resources shown to you.
Service Availability and Accuracy
We work to provide a reliable and thoughtful experience, but we do not guarantee that the Services will always be uninterrupted, secure, error-free, or available at all times.
We may update, modify, suspend, or discontinue parts of the Services at any time.
Termination
We may suspend or terminate your access to the Services at any time if you violate these Terms, misuse the Services, create risk or possible legal exposure for us, or for other lawful reasons.
You may discontinue use of the Services at any time. You may also request deletion of your account or data as described in our Privacy Policy or in the account settings available through the Services.
Limitation of Liability
To the maximum extent permitted by law, Ponderare, its affiliates, employees, contractors, partners, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of, or inability to use, the Services.
This includes, but is not limited to, damages related to loss of data, loss of profits, service interruptions, inaccurate outputs, or reliance on generated insights.
Indemnification
You agree to indemnify and hold harmless Ponderare, its affiliates, employees, contractors, partners, and service providers from and against any claims, damages, liabilities, losses, costs, or expenses arising from your use of the Services, your content, your violation of these Terms, or your violation of any law or third-party rights.
App Store and Google Play Compliance
If you download Ponderare through the Apple App Store, these Terms are between you and Ponderare, not Apple Inc. Apple is not responsible for the Services or their content.
If you download Ponderare through Google Play, these Terms are between you and Ponderare, not Google LLC. Google is not responsible for the Services or their content.
Your use of the Services may also be subject to the applicable rules, terms, and policies of Apple App Store, Google Play, or any other platform through which you access the Services.
Changes to These Terms
We may update these Terms from time to time. If significant changes occur, we will notify you through the Services, by email if provided, or by another reasonable method.
Your continued use of the Services after updated Terms become effective means you accept the revised Terms.
Governing Law
